Tax Incentives - Useful tax information for filming in Minnesota, USA

20%-25% cash rebate 'Snowbate' program.

  • 20% rebate if project shoots within a Metro area and qualified spend <

    $1M within a 12-month period (see Project Criteria).

  • 25% rebate if projects meets all the requirements for the 20% rebate AND either (1) production is located outside a Metro area OR (2) qualified spend in a Metro area >= $1M within a 12-month period.

  • Post-Production Only rebate available (see Project Criteria).

Compensation and Project Caps/ Funding Per Year

Program is administered on a first-come, first-served basis.

Annual Cap: $10M for FY2013-FY2015 with unlimited carry forward.
Project Cap: $5M.
Comp Cap: Non-resident ATL performing artist salary cap = $100K credit per person or loan-out (must be subject to MN income tax withholding).

What Qualifies

Generally, payments to resident labor, ATL non-resident performing artists subject to the cap, and local vendor payments qualify.

Application Considerations

Production company registration is not required. Submit 'Snowbate' application no earlier than 90 days before MN photography begins. Projects that have begun MN photography are not eligible. Projects applying for Post-Production Only may submit 'Snowbate' application 90 days before MN post-production begins. Allow two weeks for certification.

Application Considerations

All spending for 'Snowbate' reimbursement must occur within 12 months of certification date. 'Snowbate' expenditure reports must be completed and submitted no later than 90 days after the last day of production or post- production. Deadline extensions will be considered on a case-by-case basis. 'Snowbate' reimbursement is on a first-come, first-served basis, but submission of an application does not guarantee project will receive rebate.

'Metro area' means the area over which the Metropolitan Council has jurisdiction, including only the counties of Anoka, Carver, Dakota (excluding the city of Northfield), Hennepin (excluding the cities of Hanover and Rockford), Ramsey, Scott (excluding the city of New Prague), and Washington.

Project Criteria

Feature Film, Documentary and Music Video:

  • 20%: Minimum MN spend = $100K ($50K for MN resident applicants); must be 50% funded.

  • 25%: Minimum MN spend = $1M OR shoots minimum 60% of days outside Metro area; must be 50% funded.

National Television Series (new or relocating only): Production, development, or syndication contract from commissioning network or streaming service required.

  • 20%: Minimum MN spend = $100K.

  • 25%: Minimum MN spend = $1M OR shoots minimum 60% of days outside Metro area; must be 50% funded.

Television Pilot: Must be intended for national exhibition and reasonable commercial exploitation.

  • 20%: MN spend of $100K ($50K for MN resident applicants); must be 50% funded.

  • 25%: Minimum MN spend of $1M OR shoots minimum 60% of days outside Metro area as defined by statute; must be 50% funded.

TV Commercials:

  • 20%: Minimum MN spend = $100K not including production fee.

  • 25%: Minimum MN spend of $1M not including production fee OR shoots minimum 60% of days outside Metro areas.

Internet: Must be linear, non-interactive works presented under one creative treatment and fit into one of the above categories.

Post-production Only:

  • 20%: Minimum MN spend = $50K.

  • 25%: Minimum MN spend = $200K.
